Little River Airport Advisory Committee (minutes 5/15/98 meeting) A meeting of The Little River Airport Advisory Committee was held at the Woods Clubhouse on Sunday, May 15, 1998, at 9:00am. The agenda for this meeting had been posted at the Little River Airport and at the Little River Post Office. The agenda was revised and re-posted, at DPW's request. Present at the meeting were committee members: Tim Scully, Susan Winding, Dave Brewer, Willow Trent and Lee Edmundson. Also participating in the meeting were: Richard Gallagher, Dick Ahrens and Anne Kissack. minutes of earlier meetings --------------------------- The minutes of the 4/26/98 meeting were approved as amended. Communications: -------------- Tim Scully handed out copies of recent communications to the committee members and then read them aloud for the benefit of visitors. Appendix A: April 28 email from Tim to DPW asking for data on finances Appendix B: May 6 email to DPW following up on finances Tim Scully also handed out quite a few pages of historical airport financial data (income and expenses) received from DPW. A brief summary of the income data is in Appendix I. The expense data were very detailed and these are not reproduced in these minutes due to their length. Dave Brewer volunteered to summarize the expense data in a short spreadsheet. Appendix C: April 28 letter to DPW from Dragonfly Aviation Appendix D: May 8 letter from DPW re various airport matters Appendix E: May 12 email from DPW re requests from DPW Lee Edmundson said that he was the individual who contacted DPW, by direction of the Airport Advisory Committee. He pointed out that since we are meeting once a month, the main work of the committee will be done by subcommittees and it would make it much harder for these to get their job done if all contact with the County have to be funneled through the chair. Susan Winding said that she also called Chuck Boyer (of DPW) and that he was very helpful. Lee Edmundson said, we don't have the bureaucracy. He said, I can FAX in the future. Tim Scully said, I'll write to DPW and ask if subcommittees can contact them, provided it is done in writing. Appendix F: May 13 email from DPW re mailings Lee Edmundson said he received a copy of the land lease for the fire department picnic area. It is for $1 per year and is up for renewal this year, so our inquiry was timely. Tim Scully said he'll scan it in and add it to the minutes. Appendix G: Albion-Little River fire dept lease for picnic area Lee Edmundson said that he received a response from County Counsel regarding the handling of funds - he suggests setting up an auditor's trust account for the committee's funds. Appendix H: April 30 letter from Peter Klein to Lee Edmundson Tim Scully wondered if the committee would have a checkbook to use for paying expenses, if we set up a trust account. Lee Edmundson said, TBD. Appendix I: brief summary of airport income for the last 4 years airport activity log -------------------- Susan Winding reported that Chuck Boyer sent her copies of the log (traffic) reports from the airport. Dick Ahrens asked if any analysis has been done yet. Susan said not yet. Les Proctor's logs start in November, the worst months of the year. Lee Edmundson said, we'll need at least a whole year's data. Susan Winding said, all of the data we really need is there except the weather per day. He puts multiple days activity on one page, but there's only one place on the page for weather. Lee Edmundson comments, I don't see many "notes as applicable". Susan Winding said, let's ask that he make a note if he gets busy (for example pumping gas), stating that he got busy and missed approximately airplanes. Dave Brewer said, I'll talk to Les and ask him to do that. Willow Trent asked, can we change the form to isolate weekends vs weekdays? Lee Edmundson said, it is critical to have a separate column for date. Tim Scully said, can we ask for a "no activity" line item for "dead" days? Dave Brewer said, we can add the day of the week in the computer, when we put the data into a spreadsheet. We don't need to have Les do that. Richard Gallagher asked, how will we get statistics for Tuesday and Wednesday? Lee Edmundson said, that's a big problem. Tim Scully asked, which, the lack of statistics or the unstaffed airport? Lee Edmundson said, 2/7ths of the time there's no record kept. Dave Brewer said, this was recently extended. The airport used to be staffed 6 days and now is only open 5 days. Richard Gallagher said, but we are paying him more. Tim Scully said, but he is professional and cheerfully takes on more duties. Dick Ahrens said, other things are in flux. DPW has approved the idea of a new above-ground gas tank, fuel pump and card lock system. This opens up the possibility of fewer attended days. Richard Gallagher asked, how close are they to actually doing this? Dick Ahrens said, they have chosen the equipment. Lee Edmundson said, who was the EIR consultant? This is a seismically active area. We need to address the question of an EIR. Tim Scully said, I think the tank and pad design were selected to be appropriate for our area, with a thicker foundation pad. Willow Trent asked, will more pilots come here just for fuel? Dave Brewer said, the card lock system will record fuel sales during unattended hours. Tim Scully said, this is the only airport with fuel for a long distance up and down the coast. Lee Edmundson asked, where is the next one? Tim Scully answered, Eureka. Susan Winding asked, will the cardlock pumps accept MasterCard? Will the fuel be available to everyone? Someone answered, yes. Tim Scully asked, should we put cardlock fuel on the next agenda? Lee Edmundson said, we need an indication from DPW that the environmental considerations are ok. For most projects, planning has a checklist which includes this. It would be responsible to check the pulse of DPW to be sure they are as sensitive to this as coastal residents are. Susan Winding said, lets be sure we get a transaction analysis from the cardlock system and not just dollar totals. Richard Gallagher said, most cardlock systems record the aircraft tail number. However, in the Central Valley, most cardlock systems had reliability problems. Would our weather cause more problems? Dragonfly Aviation (see Appendix C) ------------------ Lee Edmundson said, I wish Joel were here. Tim Scully said, he'd just have to recuse himself. Susan Winding agreed. Dave Brewer said, why do they want to come here? Coast Flyers doesn't make a profit on aircraft rentals or instruction, they make their money on car rentals. Lee Edmundson said, perhaps it is the nose of the camel. Susan Winding said, maybe maintenance? Lee Edmundson said, they estimate $10,000 to $20,000 gross in the first year. Dave Brewer said, in your dreams. Lee Edmundson said, maybe they are thinking of wale watching flights? Tim Scully said, that's very different from flight instruction and requires a Part 135 permit. Willow Trent asked, what happens now? Dave Brewer explained, Coast Flyers has two airplanes. One 2 place trainer and one 4 place used for sightseeing and air taxi flights. Tim Scully said, the 4 place aircraft is part 135. Richard Gallagher asked, does he really not make money? Dick Ahrens said, I once heard him say that the airplanes make $3 per hour on the average. Dave Brewer said, and he may have other expenses. He went on to ask, do we want Dragonfly here? Lee Edmundson asked, does the airport have anything to gain? What will it cost? Dave Brewer said, the gain is competition, possibly lower fees. Lee Edmundson said, there is the risk of a local business going belly up. Dick Ahrens said, whatever you say can't discriminate among users of the airport. Tim Scully said, yes, Federal law defines the meaning of "public access airport". But County Counsel can figure that part out - he certainly handled it deftly when the timber harvest came up. Lee Edmundson said, don't they need a place to set up an office? Susan Winding said, no office, they just plan to tie the aircraft down and use an 800 number to rent the airplane. Lee Edmundson said, historically big guys will come in, such as lumber mills, drive the smaller ones out of business with low prices and then raise prices afterward. Anne Kissack asked, does Dragonfly have an affiliation with a larger business? Dick Ahrens said, I think Dragonfly has had several subsidiaries at other airports, they are experienced in doing this. I think Les Proctor is a flight instructor, I wonder if he might like to instruct? Lee Edmundson said, this doesn't pass the sniff test. I'm opposed to putting locals out of business. Anne Kissack asked, are they affiliated with other businesses? Dick Ahrens said, they were trying to come to this meeting. Lee Edmundson said, thank you, we'll come to Santa Rosa for your services, we don't want to put our neighbors out of work. Anne Kissack asked, what are their long term plans? Tim Scully said, it looks as though we need to ask for more information. Richard Gallagher said, that's called tabling. Dave Brewer said, Dick, you are a renter, how do you feel about this? Dick Ahrens said, I feel I am paying too much. The prospect of lower rates is nice. Dave Brewer asked, how many different people rent the aircraft at Little River? Dick Ahrens answered, 15-20, of whom maybe 5-8 are relatively inactive. Lee Edmundson said, we should have asked that in the survey. Willow Trent said, what about the impact on the neighborhood? Would they be aggressive about ads? Dave Brewer said, they are probably coming here for the business that is here. They'll have to serve this community. Lee Edmundson said, the upside is that there might be better equipment at a better rate. Susan Winding asked, are they doing maintenance at their other facility? Dave Brewer asked, does anyone have passion for this issue? Richard Gallagher said, we need input from Dragonfly, Joel, Les, etc. Dave Brewer said, given the information on hand, I don't favor their application. Susan Winding said, we need to remember the possible upside of lower rates. Lee Edmundson said, there's something odd about this. Who will handle the rentals? Tim Scully asked, who will give pilots the keys? Dick Ahrens said, that's easy, They could trade a bit of flying time to someone. Richard Gallagher said, I'd want to know more about a pilot who is about to rent my aircraft. How will they check credentials? Lee Edmundson asked, what's DPW asking us for [looking at DPW letter]? Tim Scully said, I have an uncomfortable feeling about this. Lee Edmundson said, short of having a Dragonfly rep here, there is no way to reach closure. Susan Winding asked, doesn't the County get a percentage? Tim Scully said, 2% of the gross. Susan Winding said, could it be that they are just looking for more revenue? Dave Brewer said, I propose that we write to DPW saying, we are uncomfortable with this proposal. We understand that the competition may lead to lower rates, but we have these concerns... Richard Gallagher said, I hate to be hostile. Dave Brewer said, but we are supposed to represent the community. Lee Edmundson said, we don't know their rates. Dick Ahrens said, it is good that there is a positive. There used to be 3 flight instructors here, now we have one part-time instructor. There's very little business here these days. Dave Brewer said, that's Dragonfly's decision. Anne Kissack said, this is the first time this has been on your agenda. Did they ask for an immediate response? Tim Scully said, the season of good flying weather is just starting. Lee Edmundson said, we should recommend that DPW find these things out before going further. Make clear to the applicant that these things will be addressed before going to the next step. Susan Winding said, we should note that Mr. Archibald tried to fly up here today, but the weather kept him from landing. Richard Gallagher said, we should make sure they don't think we are wild-eyed environmentalists ready to shoot him down. place of next meeting --------------------- Dick Ahrens reported that The Woods residents have voted, due to overuse of the Clubhouse building, that meetings with 10 or more people will pay a fee, probably $35 per meeting. An additional $10 will probably be charged for use of the kitchen. The fees will be finalized soon. Lee Edmundson said, what about meetings with fewer than 10 people? Dick Ahrens said, it isn't finalized yet, but they may be free. The $10 kitchen fee would still apply. Willow Trent asked, any chance of a special dispensation? Dick Ahrens said, possibly up to 12, the Woods management is uncomfortable with this proposed rule, it is coming from the residents. Dave Brewer said, what if we meet out of sight in this small office? Tim Scully asked, do we want to pass the hat to pay for the meeting room? Willow Trent said, I don't feel comfortable with that. We are already donating our time, should we also have to pay? Dick Ahrens said, the company is embarrassed. Dave Brewer asked, should I go looking again for another meeting place? Lee Edmundson said that all meeting rooms normally charge a fee. How many do we have at the meeting today? Eight. Dick Ahrens said, my living room holds 15. Susan Winding asked, can you meet in private homes? Dick Ahrens said, the only limitation in that the committee must meet within the limits of the County. Willow Trent said, if we are usually less than 10, then we could continue to meet here for free. Lee Edmundson asked, what about the office at the airport? Dick Ahrens said, there aren't enough chairs. Tim Scully said, we could bring some chairs. Dave Brewer said, there is activity there and the radio is blaring. But the good news is that it would be very good to have Les Proctor involved in the meetings. Lee Edmundson said, I have some 4x8 foot folding tables. I could bring one. Willow Trent said, if 18 people couldn't meet there... Lee Edmundson said, we have a sense of which issues are topical and will attract a large crowd. Susan Winding said, hangars will bring more pilots. Lee Edmundson said, we could go to the Fire Department, which controls Crown Hall. Maybe we could make a deal... Tim Scully suggested, how about forming a subcommittee of Lee and Dave to work on this issue? This met with general agreement. Lee Edmundson said, the next meeting is on June 26, but I will be out of town. Susan Winding said, I'll be gone then too. We agreed to move our next meeting to June 19 so Susan can come. The next meeting will be on July 24, when Lee will be able to attend but Susan will be out of town. Lee Edmundson listed some of the potential meeting places: St. Anthony's, Preston Hall, Crown Hall, library, new fire dept on Little Lake Rd., the kitchen at the Albion fire dept., the Whitesboro grange and the Little River Community Center. Lee Edmundson said, with respect to weed control, we should get a briefing on realistic alternatives to using Roundup. Tim Scully said, one alternative is using a blowtorch. Lee Edmundson said, the community mindset is, no herbicides. Susan Winding said, the runoff goes right through my water supply. Lee Edmundson said, the science used to analyze herbicides is flawed, I wouldn't want to live with it in my drinking water. Dave Brewer said, it is clear that this is the sense of the community. Richard Gallagher said, since the water supply is affected... Susan Winding said, there is a chain of 7 ponds which are filled from airport runoff. Lee Edmundson said, if there are viable alternatives, one should be implemented. Tim Scully said, there's the related issue of erosion control and grass planting. Richard Gallagher said, we need to be careful about attracting deer to the runway. Lee Edmundson asked, can we reactivate the grass planting project. Now that there's a budget surplus, this is a good time to find out what it would cost. Dick Ahrens said, I agree with Greg Guisti's choice of Kovar Sheep Fescue as the right grass to try. It grows to only 8" and never has to be mowed. But it might cost several thousand dollars to plant the whole area. Dave Brewer said, we've been batting this around for years. Lee Edmundson said, yes, lets act on this now. Tim Scully asked, is there really a problem with deer? Dave Brewer said, it is not a problem. Lee Edmundson asked, has the County agreed to pay for the seed? We may possibly be able to get community involvement with volunteers to help with the preparation and planting. A motion was made, seconded and passed unanimously to ask DPW to follow up with the test planting of Kovar Sheep Fescue. Lee Edmundson made a motion that we ask DPW to cease all application of herbicides at the airport and investigate alternative methods of weed control. Lee Edmundson asked, what if DPW refers this to us? Do we have a budget for such a study? The County folks make their living doing this. I don't mind doing their work for them, but they already must have large files on this. Tim Scully said, I'm sure we have no budget, but perhaps we could get copies of the data the County has already collected. Dave Brewer said, I don't share your strongly held belief regarding pesticides, but it is clear that the community is opposed to the use of any herbicide. At this stage, we are speculating that the County will refer this issue to us, let's wait and see what they ask. Lee Edmundson said, we should ask them for the material they have now. Lee's motion wasn't voted on. The operation would involve providing flight instruction and aircraft rental services. This would require an Airport Permit issued through action by the Board of Supervisors. Before we bring prepare such a Permit, we are requesting LRAAC review of the proposal. As the letter from Mr. Archibald expresses some degree of urgency, we would appreciate LRAAC comments following your 15 May 1998 meeting. In the mean time, we will inform Mr. Archibald of the process involved and of the requested review by the LRAAC. At the Health, Welfare, Planning & Transportation Committee meeting on 20 April 1998, the proposal to establish a County Integrated Pest Management Policy was discussed. One topic involved the use of herbicide (Roundup) to control vegetation at Little River Airport. The Committee proposed to refer this issue to the LRAAC for study and recommendation as to possible risk reduction associated with that usage. The approximately 3-acre parcel to be leased by Lessee under the terms and conditions of this Agreement is located adjacent to Lessee's firehouse along the easterly side of the airport access road in an area identified for possible nonaviation use in the Little River Airport Master Plan Report, and is more particularly described in the diagram attached hereto and marked Exhibit A. 3. This leased site shall be designated as a "Picnic And Recreational Area" and shall be used principally for Lessee's annual barbecue festivity, which is essentially a fund-raiser activity of Lessee. 4. Lessee may engage at its own cost and expense in clearing activities to develop and make ready the leased site as a picnic and recreation area, including a barbecue site, but no permanent facilities of any kind shall be erected or constructed. Lessee shall not place any fence around the leased site. 5. Lessee's use of the leased site shall be nonexclusive, but Lessee shall have priority of use to hold its annual fundraising barbecue festivity. Lessee may allow the occasional use of the leased site by other groups of persons for picnic and recreational use as follows: a. The occasional use by groups of less than 12 persons monitored and supervised by Lessee. b. The occasional use by groups of 12 or more persons but less than 200 persons monitored and supervised by Lessee shall be scheduled at least 15 days in advance, and Lessee shall give 10 days written notice to Lessor's Director of Public Works. c. Lessee shall not allow use of the leased site by groups of 200 persons or more. d. Lessee shall not allow the use of the leased site in excess of 30 days each year for all such activities combined, e. Use of the leased site for the foregoing activities shall be without fee or charge, except that Lessee may request donations to cover costs of clean-up and garbage, waste disposal. 6. Except as provided in paragraph 5 above, Lessee shall not assign the use of the site leased under this Agreement to any other individual or organization without the prior written approval of Lessor's Director of Public Works. Any such assignment without this written approval shall be void. 7. Any activity authorized under this Lease shall not interfere with any airport activity conducted at the Little River Airport. 8. Lessee shall pay on or before the 15th day of September of each year this Lease is in effect a yearly rental rate of $1.00. 9. a. Lessee agrees to defend, indemnify and save harmless Lessor against any and all claims, suits, damages and expenses, of anyone resulting from, arising out of or in connection with use of the leased site by Lessee or its officers, agents, employees, invitees or guests, or by any group of persons allowed by Lessee to use the leased site as described in paragraph 5 above. b. Lessee further agrees to obtain and keep in full force and effect throughout this Lease, a policy or polices of comprehensive public liability insurance, including the extension endorsement, insuring Lessee and Lessor and all of their respective agents and employees, against all claims out of or in connection with the conduct of Lessee during use of the leased site. Such policy or policies shall provide for a minimum coverage limit of $1,000,000.00 combined bodily injury and property damage liability, or its equivalent, and shall further provide that such policy is subject to cancellation only upon 30 days prior written notice delivered to Lessor's Director of Public Works. c. Lessee shall furnish to Lessor at least 10 days prior to occupancy a certificate evidencing that such insurance has been procured and is in full force and effect, together with a copy of an endorsement confirming coverage of Lessor as an additional insured. d. Lessee agrees Lessor assumes no liability whatsoever for any death, injury or loss resulting from, arising out of or connected with the activities of Lessee, its officers, trustees, employees, or anyone in or about the leased site except for any loss, injury or death directly resulting from the negligent or intentional act and/or negligent or intentional omissions of Lessor. 10. If any provision or condition agreed to in this Lease is breached by Lessee, then it shall be lawful for Lessor to serve notice of termination and thereupon this Lease shall terminate. Lessee agrees to vacate the leased site upon written notification by Lessor of any such breach and request to vacate. If the leased site is not vacated upon written notification by Lessor of breach of contract, or upon expiration or other termination of this Lease, Lessee acknowledges the right of Lessor to remove any and all property of Lessee from the leased site referred to in this Agreement. 11. In the event either party is required to commence an action in a court of law to enforce its rights under this Agreement, the prevailing party shall be entitled to reasonable attorneys fees, 12. Lessee shall provide for security and protection of the public using the leased site under this Agreement. 13. Lessee shall at all times keep the leased site in good order and condition and will, at the expiration or other termination of this Lease, surrender and deliver up the same in like good order and condition, with ordinary wear and tear and such damages by the elements, fire and other casualty which are not due to the negligence of the Lessee excepted. 14. No signs shall be displayed within the leased site without the express written approval of Lessor. 15. Lessor's Director of Public Works shall be the sole agent of Lessor authorized to do business with Lessee on behalf of Lessor under the terms of this Agreement. Lessee acknowledges that all notices required to be given by Lessee to Lessor or all approvals to be obtained by Lessee from Lessor under the terms of this Agreement shall be given to or obtained from Lessor's Director of Public Works. 16. This writing contains the complete and entire understanding of the parties to this Agreement. No representation was made or relied upon by either party other than those expressly set forth herein. No agent, employee or other representative of either party is empowered to alter any of the terms hereof, unless the same is in writing and signed by the parties hereto.
